Terms and Conditions

OFFICIAL RULES

1. PROMOTER: The Promoter for this competition is Seagate Singapore International Headquarters Pte. Ltd., 7000 Ang Mo Kio Avenue 5, Singapore 569877.
2. THE COMPETITION: Seagate Precious Memories will consist of nine national competitions and one regional final competition. The regional final competition will include the 1st, 2nd, and 3rd place winners of the national competitions. A national competition will be run in Australia, New Zealand, India, Malaysia, Thailand, China, Korea, Taiwan, and Singapore.
3. PARTICIPANT ELIGIBILITY: Entry to Seagate Precious Memories Competition is open to all journalists, photo journalists and professional bloggers who are of legal age of majority in the jurisdiction in which they reside (and at least over the age of 18 years) as of 1st June 2010 and who reside in one of the countries that the competition is being held. Participants may only enter the Seagate Precious Memories Competition in the country in which they currently reside at time of entry. Seagate reserves the right to verify the eligibility of any participant. Employees, directors, officers, and agents of the Promoter, and its affiliated companies, sales representatives, advertising, and promotion agencies involved in this contest (collectively, the “Promoter Parties”), together with the members of their immediate families and households are prohibited from entering this contest. This contest is void where prohibited.
4. COMPETITION TIMINGS: This contest begins on 28th June 2010 at 9:00 am Local Standard Time for each of the nine national competitions and closes on 18th July 2010 at 5:00 pm Local Standard Time for each of the nine national competitions.
5. THE SUBMISSION To enter, eligible participants must submit an original digital work that meets the outlined technical specifications in either the photography or video categories, provide a title and description (maximum 50 words) of their entry and their contact details including date of birth on the registration page located at. Participants may enter a maximum of twice in the Precious Memories competition with only one entry accepted for each category. All submissions must be received between the date and time the contest begins and the date and time the contest closes. The sole determinant of time for the purposes of the competition will be the Promoters servers. Participants and all submissions must comply with these Official Rules.
6. PRODUCT DETAILS: Participants may access more information about the Seagate FreeAgent GoFlex Family from http://www.seagate.com .
7. HOW TO ENTER: To enter, participants must submit their original digital work as follows. Any costs of preparing or submitting entries are the responsibility of the participant. Participants may enter only once in each category.
7.(a) Photos must be between 250KB and 2MB in size and must be uploaded as JPEG, PNG or GIF files. Accepted file extensions are: .jpg .jpeg .png .gif.
7.(b) Video movie files must be a maximum of 20MB and no longer than 90 seconds in length. They must be uploaded as FLV, WMV, MP4, MOV or AVI video files. Accepted file extensions are: .flv .wmv .mp4 .mov .avi).
8. JUDGING: The 1st, 2nd, and 3rd place winners in each category of each national competition will be the three valid entries that have received the most unique, human generated votes online during the voting period which will commence at 9am on 28th June 2010 and run until 5pm 25th July 2010 (local time for each national competition). In the event of a tie-breaker, the Seagate Asia Pacific Corporate Communications Director will make the final decision based on assessment of the creativity and originality of the entries.
The three winners in each category for the nine national competitions will then advance to the regional competition. The regional winners (1st, 2nd, and 3rd) in each category will be those that are voted by a Seagate selected judging panel to be the most creative and original entries in each of the two categories.
The judges decisions on all matters pertaining to this contest are final. This is a contest of skill; chance plays no part in determining the winners.
9. ONLINE VOTING: Online voting in each national competition is open to any person who registers fully and accurately at and follows the directions provided. Only one vote per category per voter will be accepted. After voting an email will be sent to each voter. The voter must click on the link provided in the email to validate the vote. Votes that are not validated will be disqualified.
Voters will also be offered the chance to win a prize.
10. PRIZE DETAILS: National competition winners will receive the following prizes:

1st prize - FreeAgent® GoFlex Desk 1TB drive plus US$500
2nd prize - FreeAgent GoFlex Ultra-Portable 500GB drive plus US$200
3rd prize - FreeAgent GoFlex Ultra-Portable 320GB drive plus US $100.

Video category
1st prize - FreeAgent GoFlex Desk 1TB drive plus US$800
2nd prize - FreeAgent GoFlex Ultra-Portable 500GB drive plus US$500
3rd prize - FreeAgent GoFlex Ultra-Portable 320GB drive plus US $200

Regional competition winners will receive the following prizes:

2nd prize - FreeAgent GoFlex Desk 2TB drive plus US$600
3rd prize - FreeAgent GoFlex Pro Ultra-Portable 500GB plus US $300

At the end of the online voting in each national competition, one registered voter in each category will be selected at random and if they have correctly answered a question online at the time of voting they will receive a Seagate GoFlex Ultra-Portable 320GB.
All cash prizes will be awarded in the currency of the country in which each place winner entered. All prize values will be calculated using the value of the US dollar as at the date on which the prize winners are determined.
In the event that the Promoter is unable to supply the prize, the Promoter reserves the right to supply an alternative prize of similar monetary value. The Promoter accepts no responsibility for any tax implications arising from the award of any prize. Non-cash prizes are not exchangeable and cannot be taken as cash.
11. WINNER VERIFICATION: The winning participants of the national competitions will be notified by e-mail, and their names will be posted on 10th August 2010. The winning participants of the regional competitions will be notified by e-mail, and their names will be posted on 25th August. If the prize notification is returned as undeliverable, or any prize documentation is not completed as required by the Promoter, then the prize will be forfeited. The prizes will be dispatched to the winners as soon as practicable following the announcement of the winners. Competition winners will need to provide proof of identity to receive the prizes.
12. SUBMISSIONS REQUIREMENTS: All entries must be the original work of the Participant and must not have been previously entered into Seagate Precious Memories (2007 or 2008). The submissions must not defame or invade publicity rights or privacy rights of any person, living or deceased. The submissions must not infringe upon any persons personal or proprietary rights. Entries not complying with all rules will be subject to disqualification at the Promoter’s discretion. The Promoter will not enter into correspondence with participants regarding individual submissions.
13. DISQUALIFIED SUBMISSIONS: The Promoter reserves the right to disqualify any entry which does not comply with these Official Rules, or which the Promoter believes is offensive or in breach of any defamation, copyright, privacy, or other laws in each country the competition is running. The participant will be informed of the decision and may submit an alternative submission in its place, so long as the alternative submission complies with these Official Rules and is received before the competition closes.
14. USE OF SUBMISSIONS. Participants grant to the Promoter and its agents a worldwide, perpetual, irrevocable, right, and royalty-free license to make use of the submission and any copyright material contained in the submission, including the right to copy, duplicate, alter, and modify the submission in whole or in part, in any media whatsoever. Additionally, as a condition of acceptance of a prize, except where prohibited by law, the winning participants will be required to grant the Promoter the right to use the participant’s name, image, likeness, and biographical materials for advertising, publicity, and promotional purposes in any media whatsoever, and without additional compensation.
15. PERSONAL INFORMATION: The Promoter collects and holds personal information provided with each entry and vote to be used for the purposes of running the competition and in particular to notify prize winners and to verify prize winners identities. All personal information provided by Participants and voters will be held by Einsteinz Communications at 38 Albany Street, St Leonards NSW 2065 AUSTRALIA. Participants and voters have the right to access and correct their personal information by emailing mailto:seagatepr@einsteinz.com.au. The Promoter will destroy all records of personal information once all prizes have been dispatched, with the exception of Participants name and any bibliographic information submitted by the Participant.
16. DISCLAIMERS: The Promoter Parties will not be liable for any loss or damage arising out of participation in this competition or receiving any prize, except for any liability that cannot be excluded by law. The Promoter Parties are not responsible for late submissions or submissions that are not received. The Promoter Parties are not responsible for interrupted or unavailable network, Internet, or email connections, failed communications, website inaccessibility or unavailability, or other errors of any kind, including the incomplete or incorrect capture of submission information.
If any portion of the competition is compromised by virus, worms, bugs, non-authorized human intervention, or other causes which, in the opinion of the Promoter, may corrupt or impair the administration, security, fairness, or proper play, or the submission of entries or votes, then Promoter reserves the right to suspend, modify, or terminate all or part of the competition and select winners for the eligible, non-suspect entries received, or as otherwise deemed fair and appropriate by Promoter. The Promoter reserves the right to cancel, suspend or modify the Contest if it cannot be conducted as originally planned due to occurrences beyond the Promoter’s control.
17. GENERAL CONDITIONS: By participating in this contest, participants agree to abide by and be bound by these Official Rules and the decisions of the judges. Participants are responsible for all taxes, costs, or other liability including custom charges which might arise from receiving the awarding, receipt, or use of any prize. By participating in this contest, participants agree to release the Promoter Parties from any and all liability arising from or in connection with participation in this Contest, or the awarding, receipt, or use of any prize. By participating in this contest, participants further agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants rights and obligations, or the rights and obligations of the Promoter Parties in connection with this contest will be governed by, and construed in accordance with, the laws of the country region in which they entered the competition, without giving effect to any choice of law or conflict of law rules. By entering, participants submit to the jurisdiction and venue of the courts located in Singapore.
